Q1. How can one file a complaint before the Lokayukta?

Ans.Any person may make a complaint in the prescribed form to the Lokayukta giving specific details of the case supported by relevant documents and accompanied by an affidavit in support of the allegations in the complaint. A fee of Rs. five hundred only shall be paid in the form of judicial stamps along with the complaint.
Acomplaint against the Chief Minister, a Minister or a Member of Legislative Assembly shall be in Form-I accompanied by an affidavit in Form-III in support of its contents and acomplaint agains to the public functionaries shall be in Form-II accompanied by an affidavit in Form-III in support of its contents.

Q2. Do Judicial Officers/Civil Servants also come under the purview of the Delhi Lokayukta & Uplokayukta Act, 1995 ?

Ans.Any member of the Judicial Services who is under the Administrative Control of the High Court under Article 235 of the Constitution and any person who is a member of a Civil Service of the Union or an All India Service or Civil Service of State or holds a Civil Post under the Union or a State in connection with the affairs of Delhi do not come under the jurisdiction of the aforesaid Act.

Q3. What type of matter are not subject to inquiry under the Act?
         
Ans. The Lokayukta shall not inquire into any matter -
which has been referred for inquiry under the Commissions of Inquiry Act, 1952 (60 of 1952);
or relating to an allegation against a public functionary, if the complaintis made after expiration of a period of five years from the date on which the conduct complained against is alleged to have been committed .

Q4. How can one obtain a copy of the Act?

Ans.A copy of this Act is available on nominal charges of Rs.Ten only at this office or it can be downloaded from our Website.

Q5. Does the Lokayukta also entertain anonymous complaints?

Ans.The Lokayukta has power to take cognizance suo-motu on the basis of any information that he may receive or, otherwise,comes to his notice provided a prima-facie proof in support of the allegations made in the anonymous complaints is furnished.

Q6. To whom one may contact in case of any querry or difficulty in filling a complaint under the Act ?

Ans.The individual may contact the Registrar/ Assistant Director for the redressal of his problem.

Q7. Who are authorised to attest the affidavit which are to be filed along with the compaint before the Lokayukta ?

Ans.Affidavits may be sworn before the Registrar to the Lokayukta be sides the authorities already empowered under any law before whom affidavits may be sworn.

Q8. What type of complaints against Public Functionary is entertained under the Act?

Ans.The under mentioned allegations in relation to a Public Functionary is entertained under theAct-

if the public functionary has failed to act in accordance with the norms of integrity and conduct which ought to be followedbyhim/her or the class to which he belongs; if the public functionary has abused or misused his/her position to obtain any gain or favour to himself/herself or to any other person or to cause loss or undue harm or hardship to any other person;

2.if the public functionary has abused or misused his/her position to obtain any gain or favour to himself/herself or to any other person or to cause loss or undue harm or hardship to any other person;
 

3.f the public functionary was actuated in the discharge of his/her functions by improper or corrupt motives or personal interest;

4.if the public functionary is or has at any time during the period of his/her office been in possession of pecuniary resources or proporty disproportionate to his/her know resources of income whether such pecuniary resources or property are held by him/her personally or by any member of his/her family or by some other person on his/her behalf.
